KNOW ALL BY THESE MEN PRESENTS:
That WE, ARQUILITO CLAUDEN, SATURNINO TEBALAN, DOLORES COBELLO, VICTORIA BAHIAN, RUFO TEBALAN, ERA PALMA, JULIET PALMA CALUNOD, ANNE FE PALMA LORETO and PRIMO DOMINGUEZ, All of legal age, Filipino and residents of Maigo lanao Del Norte, by these presents, do hereby freely and voluntarily state and declare as follows:
That we are some of the descendants-heirs of the late Dionesio Kilat of Siquijor province.
That the late Dionesio Kilat left among others, a parcel of land containing and area of 48,831 square meters, situated in Bitaug Enrique Villanueva, Siquijor and declared for taxation in the name of the said deceased (Dionesio Kilat) (Lot 246).
That being the descendants- heirs of the deceased, we have agreed and decided,
as follows:
1. That in the event that the above-mentioned parcel of land will be
sold by agreement of all the heirs to any interested buyer, the selling
price should be one ONE THOUSAND (P1,000.00) PESOS per square meter.
2. That if the purpose of the buyer of the land is to engage in mining
to extract any mineral deposit in the land, we and the other heirs should
be entitled to recieve THIRTY FIVE PERCENT (35%) every quincena from the
buyer-miner on the net income to the mining operation of the land. This
is in addition to the buying price of Thousand (P1,000.00) PESOS per square
meter.
3 That if the purpose of the land is to develop the land to any business
venture other than mining, we will not be entitled to the additional THIRTY
FIVE PERCENT (35%) share as stated in paragraph 2 hereof.
4. That we have fully understood the terms of this agreement.
IN WITNESS WHEREOF, we have herunto set our signatures this 4th day of
June, 2002 at Maigo Lanao Del Norte, Philippines.
